While CBD is not currently allowed to be marketed as a dietary supplement, FDA wrote that it “has the authority to remove this exclusion through rulemaking.” Answering these questions—through the reopened public docket as well as discussions with government partners—will help facilitate that process. The docket will remain open “indefinitely” for stakeholders to submit relevant information to assist in the rulemaking process, it said. While the process remains ongoing, the agency announced that it is actively exploring pathways to allow for the marketing of cannabidiol as a dietary supplement and is developing enforcement discretion guidance.

Our continuing review of information that has been submitted thus far has not caused us to change our conclusions. Based on available evidence, FDA has concluded that THC and CBD products are excluded from the dietary supplement definition under section 201 of the FD&C Act [21 U.S.C. § 321]. FDA considers a substance to be “authorized for investigation as a new drug” if it is the subject of an Investigational New Drug application that has gone into effect. Under FDA’s regulations (21 CFR 312.2), unless a clinical investigation meets the limited criteria in that regulation, an IND is required for all clinical investigations of products that are subject to section 505 of the FD&C Act. Our dissemination network of over 5,000 downstream distribution points allows us to deliver unparalleled reach, visibility and recognition to companies operating in both cannabidiol and the wider cannabis space. Although Congress intended for the FDA to regulate CBD under agriculture legislation, FDA officials have stated that developing rules for CBD is complicated because it already exists as an FDA approved drug. There’s not much cause for celebration — FDA continues to kick the can down the road, claiming that more study is needed before it takes action. The agency’s delay results in the worst of both worlds — U.S. hemp farmers are denied profitable markets for their crops, while unregulated products continue to proliferate, with no safeguards for public health and safety. The appealwas made on the basis of the Hemp Farming Act of 2018. Co-sponsored by Wyden, Merkley, and Representative James Comer of Kentucky, the Act was incorporated into the 2018 Farm Bill and became law on December 2018.
